Private international law

Private international law is at the heart of cross-border legal issues. From international trade to family law, from employment law to consumer protection, private international law provides a key set of rules that come into operation whenever a court is faced with a case with a foreign aspect.

Due to the potentially widespread application of private international law, the subject matter is appealing to many members of the legal profession, and with this in mind the members of the Private International Law Commission aim to learn from each other’s experiences.

Over the past years, the Commission has been successful in attracting a diverse group of lawyers who are all interested in sharing their ideas and their experiences from their own jurisdictions.
Although many private international law rules have been harmonised, there still is a strong influence of national and regional systems of law, which can cause conflicts of rules of law. The constantly evolving, exciting nature of this field of law makes for passionate discussions among professionals.

The Commission has been present at all the UIA’s Annual Congresses with a separate or joint session, dealing with various subjects such as obtaining evidence abroad, international insolvencies, cross-border protection of IP rights, international directors’ liability and public policy restrictions in commercial contracts.

On the basis of an interesting case study, the members of the Commission provide the audience with food for thought, after which an interactive discussion takes place in order to discuss the relevant issues thoroughly. This format has worked very well over the past years, and the Commission will try to continue this tradition in the coming years.

The Private International Law Commission is constantly looking for new, young members to join and provide further input to the Commission, in order to raise both the social and scientific level of the Commission’s activities.

The Commission board will be more than happy to provide you with further details about the Commission and is looking forward to welcoming new members.
